NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCE OF WINNING. BY PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT. THESE OFFICIAL RULES REQUIRE YOU TO AGREE TO ARBITRATE DISPUTES YOU BRING AGAINST US RATHER THAN GOING TO COURT, GRANT US CERTAIN RIGHTS AND LICENSES, PROVIDE US CERTAIN INDEMNITIES, WAIVE CERTAIN OF YOUR RIGHTS AND REMEDIES, AND LIMIT OUR LIABILITY AND OBLIGATIONS TO YOU. READ THEM CAREFULLY AND DO NOT PARTICIPATE IN THE SWEEPSTAKES IF YOU DO NOT AGREE.
DATES OF SWEEPSTAKES: Entries to the National Entrepreneurship Month Sweepstakes (the “Sweepstakes”) can be submitted between 12:01am ET on November 1, 2024, and 11:59pm ET on November 30, 2024 (the “Sweepstakes Period”). Sponsor’s computer shall be the official timekeeping device for the Sweepstakes.
ELIGIBILITY: The Sweepstakes is open only to domestic businesses (corporations, limited liability corporations, partnerships, or sole proprietorships) who have registered to do business in one of the 50 United States or the District of Columbia (each, a “Business”) and which have a business website and a LinkedIn account and LinkedIn Company Page. Each individual who submits an entry represents and warrants that they are at least eighteen (18) years of age or older at the time of entry and that they are employed by or otherwise authorized to act on behalf of the Business on whose behalf they are entering (such Business referred to as the “Entrant”). If your Business does not have a LinkedIn account or Company Page, you can set one up for free by going to https://www.linkedin.com/ and following the instructions to set up a free account and Company Page. By entering this Sweepstakes, you understand and agree that this Sweepstakes is not sponsored or administered by LinkedIn Corporation and that you release LinkedIn Corporation from any and all liability related to this Sweepstakes. The Sweepstakes is subject to all federal, state, and local laws and regulations, and is void wherever restricted or prohibited by law. Officers, directors, managers and employees of Acrisure, LLC (“Sponsor”), and each of its respective parent companies, subsidiaries, affiliates and related companies, advertising and promotion agencies, consultants and agents, and other Released Parties (defined below), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such person and any others engaged in the development, production, execution or distribution of this Sweepstakes are not eligible to participate. Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Sweepstakes.
TO ENTER: During the Sweepstakes Period, go to www.acrisure.com/national-entrepreneurship-month and enter the requested information. There will be a limit of one (1) entry per Business for the entire Sweepstakes Period.
Neither Sponsor nor any Released Party (defined below) is responsible for any entry that is lost, late, misdirected or undeliverable, whether due to your account settings, system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. No mechanically or programmatically reproduced entries are permitted. Any attempt by an Entrant to obtain more than the stated number of entries allowed by using multiple/different identities, and/or any other methods will void that Entrant’s additional entries. In the event of a dispute regarding the identity of an Entrant, the entry will be assigned to the Business associated with the business website submitted with the entry.
WINNING: Within approximately one to two weeks after the end of the Sweepstakes Period, thirteen (13) potential winners will be selected from among all eligible entries received during the Sweepstakes Period and will be eligible to receive the following prizes:
- Grand Prize (3): Each Grand Prize winner will receive a one (1) hour virtual business consultation with Greg Williams, Acrisure’s Chairman & CEO (No Approximate Retail Value is assigned to this prize)
- 2nd Prize (10): 10.9” Apple iPad (ARV: $349 each)
Total ARV of Prizes: $3,490
Odds of winning depend on the number of entries received.
Each potential winner is subject to verification by Sponsor and is not a winner unless and until that Entrant’s eligibility has been verified and Entrant has been notified that verification is complete.
Receiving a Prize is contingent upon compliance with these Official Rules. The potential winners will be required to execute certain documents, which may include without limitation an affidavit of eligibility/liability release, tax forms, and a publicity release (collectively, “Prize Claim Documents”). If a potential winner cannot be contacted, does not wish to accept the Prize, or fails to sign and return the Prize Claim Documents within the time period specified by Sponsor, that potential winner forfeits the Prize, and a different potential winner will be selected from amongst the remaining eligible entries. If after two alternate drawings a winner for a specific Prize cannot be verified, then that Prize will not be awarded.
Each Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. The consultations provided to Grand Prize Winners are for informational purposes only and should not be used as or relied upon as a substitute for professional advice, and the Prize Claim Documents required from the Grand Prize winners will include a waiver and release acknowledging this fact. Grand Prize consultations will be scheduled subject to Mr. Williams’ availability. No Prize substitution or cash redemption of Prizes, except that Sponsor reserves the right to substitute any Prize with a prize of comparable or greater value if a Prize should become unavailable for any reason. Each winner is responsible for all federal, state, and local taxes arising from receipt, possession, acceptance, or use of any Prize, if applicable. Each Prize will be awarded to the Business associated with the winning entry, which may distribute it amongst its employees or otherwise at its discretion.
No more than the number of Prizes set forth in these Official Rules will be awarded.
GENERAL CONDITIONS: Should any portion of the Sweepstakes be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, or to conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. In such event, Sponsor reserves the right to award the Prizes at random from among the eligible entries received up to the time of the impairment or to not award the Prizes at all. Sponsor reserves the right in its sole discretion to disqualify any Entrant it finds to be tampering with the entry process (including without limitation by using any automated or robotic process to submit more than the permitted number of entries) or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate, or false entry. ANY ATTEMPT BY ANY PERSON OR BUSINESS TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR BUSINESS TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
RELEASE: By participating in this Sweepstakes, Entrant agrees to release and hold harmless Sponsor and each of its and their respective officers, directors, managers, employees, parent companies, subsidiaries, affiliates, agents, members, shareholders, insurers, divisions, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, including consultants and legal advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, redemption or use of any Prize.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (i) unauthorized human intervention in any part of the entry process or the Sweepstakes; (ii) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (iii) any injury, damage or loss (including death) to persons or property of any kind, which may be caused, directly or indirectly, in whole or in part, directly or indirectly from Entrant's participation in the Sweepstakes or from the receipt, use or misuse of any Prize; (iv) any printing or typographical errors in any Sweepstakes-related materials; (v) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries; or (vi) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software. In no event will any of the Released Parties be liable for any indirect, special, punitive, incidental, or consequential damages, even if advised of the possibility of such damages, and regardless of the theory of law under which damages are based. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO THE FOREGOING MAY NOT APPLY TO YOU.
CHOICE OF LAW: These Official Rules shall be construed in accordance with the laws of the State of Michigan without regard to its conflict of laws rules.
DISPUTE RESOLUTION; BINDING ARBITRATION; EXCEPTIONS TO ARBITRATION:
- We each agree to first contact the other party with any Disputes (as defined below) and provide a written description of the problem, all relevant documents/information and the proposed resolution. You agree to contact us with Disputes by contacting us at the address provided in these Official Rules. We will contact you based on the contact information you have provided us.
- You agree to submit all Disputes (subject to any specific exceptions below) to arbitration. In arbitration, there is no judge or jury and review is limited. However, just as a court would, the arbitrator must honor the terms and limitations in these Official Rules and can award the same damages and relief. The arbitrator’s decision and award is final and binding, with some exceptions under the Federal Arbitration Act (“FAA”), and judgment on the award may be entered in any court with jurisdiction. We each also agree as follows:
- “Disputes” are any claims or controversies against each other related in any way to the Sweepstakes or these Official Rules – this includes claims you bring against our officers, directors, employees, partners, successors, agents, affiliates, subsidiaries and their related companies.
- If either of us wants to arbitrate a Dispute, we agree to send written notice to the other party providing a description of the Dispute, previous efforts to resolve the Dispute, all supporting documents/information, and the proposed resolution. We agree to make reasonable attempts to resolve the Dispute prior to initiating arbitration. If we cannot resolve the Dispute within forty-five (45) days of receipt of the notice to arbitrate, then we may submit the Dispute to formal arbitration.
- The FAA applies to these Official Rules and this arbitration provision. We each agree that the FAA’s provisions, not state law, govern all questions of whether a Dispute is subject to arbitration.
- The arbitration will be administered by the American Arbitration Association (“AAA”) under its arbitration rules. If any AAA rule conflicts with these Official Rules, these Official Rules will apply. You can obtain procedures, rules and fee information from the AAA at 1-800-778-7879 or www.adr.org.
- The federal or state law that applies to these Official Rules will also apply during the arbitration. The arbitration will be conducted by a single neutral arbitrator and will take place in Grand Rapids, Michigan. If deemed appropriate by the arbitrator and permitted by the AAA arbitration rules, meetings or hearings in the arbitration may be conducted by video conference.
- We each agree not to pursue arbitration on a classwide basis. We each agree that any arbitration will be solely between you and us (not brought on behalf of or together with another individual’s claim). If for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then your agreement to arbitrate doesn’t apply and the Dispute must be brought in court in the state or federal courts located in Grand Rapids, Michigan.
- To the extent allowed by law, the prevailing party in the arbitration or in a lawsuit will be entitled to recover its costs and expenses, including reasonable attorneys’ fees and experts’ fees, which are incurred in connection with the arbitration or lawsuit.
- Either of us may bring qualifying claims in small claims court, and while you agree to submit all Disputes to arbitration, Sponsor may, at its option, pursue any Disputes or claims against you in court by filing a lawsuit, or alternatively by submitting the Dispute to arbitration in accordance with the above terms.
NO CLASS ACTIONS: TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASSWIDE BASIS; THAT IS, TO EITHER JOIN A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE IN ANY LAWSUIT, ARBITRATION OR OTHER PROCEEDING.
NO TRIAL BY JURY: TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY LAWSUIT, ARBITRATION OR OTHER PROCEEDING.
ENTRANT’S INFORMATION: Information collected from Entrant is subject to Sponsor’s privacy policy, available at https://acrisure.com/privacy. By entering the Sweepstakes, Entrant agrees to receive communications from Sponsor or its affiliates or marketing partners electronically, including, but not limited to, those related to advertisements and marketing of Sponsor’s services. You agree that all agreements, notices, disclosures and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You grant us the right to continue to send such emails until you specifically notify us that you wish to no longer receive such emails.
WINNERS LIST: For the names of the Winners, visit www.acrisure.com/national-entrepreneurship-month-winners approximately one month after the date of the drawing described above.
SPONSOR: Acrisure, LLC, 100 Ottawa Avenue SW, Grand Rapids, MI 49503.
